Power of Attorney

Power of Attorney Near Killeen

Power of Attorney Planning From a Firm Established in 1992

A power of attorney lets you, as the principal, authorize an agent to handle specified matters on your behalf. It may address incapacity, illness, travel, or another defined circumstance. The scope and timing of that authority depend on the language used and applicable Texas law.

Financial and health care decisions require separate planning. A durable financial authorization commonly covers property and financial matters, while a medical power of attorney names a health care agent to act when you can’t make or communicate medical decisions.

At Law Office of Nancy Perry Eaton, PLLC, established in 1992, we assist Killeen and Central Texas residents with these documents as part of a coordinated estate planning process. Nancy Perry Eaton works directly with clients to understand their circumstances, explain their options, and document their decisions clearly.

Financial & Medical Authority for Killeen Families

The right planning depends on who should act, what that person may do, and when the authority should begin. We guide clients through those decisions while keeping each instrument’s legal role clear.

Durable Financial Authority

A Texas statutory durable power of attorney can authorize an agent to manage selected financial and property matters. When properly drafted, it can remain effective if the principal later becomes disabled or incapacitated. Its terms may grant broad authority or limit the agent to particular transactions and responsibilities.

Medical Decision-Making

A medical authorization designates a health care agent to make decisions when the principal can’t make or communicate them. It’s separate from a durable financial document and should be coordinated with any advance medical directive.

Timing & Limits

Authority may begin immediately, on a specified date, or after a defined triggering condition, depending on the form used. Certain actions, including gifts and changes to beneficiary designations or rights of survivorship, generally require express authority under the Texas Estates Code.

Texas Requirements for Durable Authority

A durable instrument generally must be in writing, identify the agent, contain appropriate durability language, and be signed by the principal or at the principal’s direction. The signature ordinarily must be acknowledged before an authorized officer. Specific requirements can vary based on the authority granted and the transaction involved.

Practical issues that may affect its use include:

  • Third-party review: A person or institution may request an agent certification, legal opinion, or English translation in circumstances permitted by the Texas Estates Code.
  • Express powers: An agent can’t exercise authority that the document must specifically grant.
  • Recording: Recording requirements may depend on the transaction, property, and governing law.
  • End of authority: The agent’s authority operates during the principal’s lifetime and ends at death. A will controls different matters after death.

How We Coordinate Your Estate Planning Documents

We begin by reviewing your family circumstances, assets, intended agent, preferred timing, and desired limits. We may also discuss a successor agent and safeguards suited to the responsibilities being assigned.

Nancy Perry Eaton explains how financial and medical authorizations fit with wills, trusts, and advance medical directives. We keep clients informed as they make and document their estate planning decisions. Payment plans and financing options are available under our current policies.
